Terms of Service

Welcome to Seek Arcana ("Arcana", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the Arcana platform at seekarcana.com, including all features, tools, and services offered through the platform. By creating an account or using the platform, you agree to be bound by these Terms.

1. The Platform

Arcana is a marketplace that connects tarot seekers ("Seekers") with tarot readers ("Readers"). Arcana provides the platform, tools, and infrastructure for bookings, payments, and communication. Arcana does not itself provide tarot readings and is not a party to the reading session between a Seeker and a Reader.

2. Eligibility

You must be at least 18 years old to create an account on Arcana. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update your information as needed. Arcana reserves the right to suspend or terminate accounts that violate these Terms.

4. Seeker Terms

4.1 Booking and Payment

Seekers may browse reader profiles, select reading types, and book sessions through the platform. Payment is required at the time of booking and is processed through Stripe. Funds are held in your Arcana wallet until applied to a booking.

4.2 Cancellations and Refunds

Seekers may cancel a booking up to 24 hours before the scheduled session for a full refund to their Arcana wallet. Cancellations made within 24 hours of the session may not be eligible for a refund. No-shows by the Seeker are not refundable. If a Reader cancels or fails to appear, the Seeker will receive a full refund.

4.3 Reviews

Seekers may leave reviews and ratings after a completed reading. Reviews must be honest, respectful, and based on the actual reading experience. Arcana reserves the right to remove reviews that contain abusive language, personal attacks, or content unrelated to the reading.

5. Reader Terms

5.1 Application and Vetting

All Readers must apply and be approved before listing on the platform. Arcana reviews each application for experience, skill, ethics, and commitment to the practice. Approval is at Arcana's sole discretion. Arcana may revoke a Reader's listing at any time for violations of these Terms or platform policies.

5.2 Pricing and Services

Readers set their own prices, reading types, and availability. By listing on Arcana, Readers agree that their profile information (name, bio, specialties, pricing, ratings, and reviews) will be publicly visible to Seekers.

5.3 Commission and Payouts

Arcana charges a commission on completed bookings. The commission rate depends on the Reader's subscription plan (Apprentice: 20%, Seer: 15%, Oracle: 10%). Commissions are deducted automatically before payout. Payouts are processed weekly to the Reader's linked bank account or Arcana wallet. Commission is not charged on cancelled sessions or no-shows by the Seeker.

5.4 Reader Conduct

Readers agree to conduct themselves professionally, arrive on time for sessions, and provide the reading type that was booked. Readers may not solicit Seekers to transact outside the Arcana platform. Readers may not make medical, legal, or financial claims during readings.

6. Prohibited Conduct

All users agree not to:

• Use the platform for any unlawful purpose.
• Harass, abuse, or threaten other users.
• Impersonate another person or misrepresent your identity or qualifications.
• Attempt to circumvent the platform's payment system or solicit off-platform transactions.
• Post false, misleading, or defamatory content.
• Interfere with the operation of the platform or attempt to access systems or data you are not authorized to access.
• Use automated tools, bots, or scrapers to access the platform.

7. Intellectual Property

The Arcana platform, including its design, branding, code, and content (excluding user-generated content), is the property of Seek Arcana and is protected by applicable intellectual property laws. Users retain ownership of content they create on the platform (journal entries, reviews, profile content). By posting content on Arcana, you grant us a limited, non-exclusive license to display that content as necessary to operate the platform.

8. Disputes Between Users

Arcana provides dispute resolution support for issues arising from reading sessions. If a Seeker and Reader cannot resolve an issue directly, either party may submit a dispute to Arcana for mediation. Arcana's dispute resolution decisions are final and binding. Arcana may issue refunds, credits, or account actions as it deems appropriate.

9. Disclaimers

Arcana is a platform for connecting Seekers with Readers. We do not guarantee the accuracy, quality, or outcomes of any reading. Tarot readings are provided for entertainment, personal reflection, and spiritual guidance purposes. Readings should not be considered a substitute for professional medical, legal, financial, or psychological advice.

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Arcana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the platform.

11. Indemnification

You agree to indemnify, defend, and hold harmless Seek Arcana, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the platform, your violation of these Terms, or your violation of any rights of another.

12. Modifications to the Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and notify registered users by email if the changes are material. Your continued use of the platform after any changes constitutes your acceptance of the updated Terms.

13. Termination

You may close your account at any time by contacting us. Arcana may suspend or terminate your account at any time for violations of these Terms, with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Orange County, California.
